My speculation is that this line:
<ncml:attribute name="_FillValue" type="short" value="65535" isUnsigned="true" 
/>
is not being properly handled by the netcdf-java code. Specifically,
the isUnsigned looks like it is being ignored.

One additional check. try this command:
    ncdump -h -s test.nc
and post the output here.
